Terms of Service
These Terms govern your use of the Chairside platform — the marketing site at bookchairside.com and the admin app at admin.bookchairside.com (together, the “Service”).

1. Who's agreeing to what
By creating an account or using the Service, you agree to these Terms with [TODO: legal entity name] (“Chairside”). If you're using the Service on behalf of a business, you represent that you have authority to bind that business.
2. Accounts
You're responsible for activity under your account, including keeping your password safe and configuring permissions correctly for your staff. Tell us right away if you suspect unauthorized access.
3. What the Service does
- Lets barbershops accept and manage bookings online.
- Sends SMS and email to customers on the shop's behalf.
- Processes payments through Stripe.
- Generates AI replies to inbound customer SMS, when enabled.
4. Acceptable use
You agree not to use the Service to:
- Send marketing or promotional SMS to recipients who didn't opt in.
- Send messages that promote illegal goods or services (the “SHAFT” categories: Sex, Hate, Alcohol, Firearms, Tobacco) where prohibited by carriers.
- Impersonate another person or business.
- Probe, scan, or test the security of the Service without permission.
- Reverse engineer or scrape the Service.
- Use the Service to violate any law or regulation, including TCPA, CAN-SPAM, GDPR, and CCPA.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
5. Customer data and your responsibilities
When you upload customer information into the Service (including phone numbers used for SMS), you represent that you collected it lawfully and obtained the consents required to send each message you ask Chairside to deliver. You are the “data controller” for that information; Chairside is your “data processor.”
6. Pricing and payment
Chairside is pay-as-you-go. You top up your account balance and we deduct from it as bookings, SMS, emails, and AI calls are used. Current per-unit prices are listed on /pricing. Prices are in USD. We may change prices on 30 days' written notice; changes don't apply retroactively to credit you've already purchased.
Stripe processes all payments. Refunds for unused balance are available on request within 30 days of the most recent top-up.
7. Third-party services
Some Service features rely on third-party platforms (Twilio, Stripe, Anthropic). Their terms apply when you use those features. We're not responsible for outages or actions of these providers, though we'll make reasonable efforts to notify you and find workarounds.
8. Intellectual property
The Service, including its software, design, and content (excluding your data), is owned by Chairside and protected by copyright and other laws. We grant you a limited, non-exclusive, revocable license to use it as the Service intends. You retain all rights to data you upload.
9. Beta and AI features
Some features are labeled beta or are AI-generated (e.g. auto-replies). They may produce inaccurate or unexpected output. You are responsible for reviewing AI-generated content before it leaves your shop.
10. Termination
You can cancel any time from /admin/settings. We may terminate accounts for material breach, non-payment, or inactivity over 24 months. Upon termination, you can export your data for 30 days; after that we delete it (except where retention is legally required).
11. Disclaimers
The Service is provided “AS IS” without warranties of any kind. We don't guarantee uninterrupted operation, error-free results, or that messages will reach every recipient (carriers sometimes filter or delay SMS).
12. Limitation of liability
To the fullest extent allowed by law, Chairside's total liability arising from the Service is limited to the greater of (a) the fees you paid us in the 12 months before the claim, or (b) USD $100. We're not liable for indirect, consequential, or punitive damages, including lost profits.
13. Indemnification
You agree to indemnify Chairside against claims arising from your misuse of the Service, your messages, or your violation of these Terms or applicable law.
14. Governing law and disputes
These Terms are governed by the laws of [TODO: governing-law state], without regard to conflict-of-laws rules. Disputes will be resolved in [TODO: forum] on an individual basis — no class actions or class-wide arbitration.
15. Changes to these Terms
We may update these Terms. If we make a material change, we'll notify active account holders by email at least 14 days in advance. Your continued use after the change means you accept the update.
